On Kapil Sibal’s demand, Justice L Nageshwar Rao said, “We cannot stop sabotage in the whole country.”
The case of Jahangirpuri is not national. “We want a ban on bulldozer vandalism,” Kapil Sibal said. In his reply, Justice Rao said that sabotage is always done by bulldozers.
However, the status quo has been maintained in Jahangirpuri till the next order of the Supreme Court. This means that action against encroachment cannot be taken at present.
Dushyant Dave, another senior lawyer appearing for the Jamiat Ulema-e-Hind, told the apex court that the matter raises far-reaching questions of constitutional and national importance.
This case is not limited to Jahangirpuri. The rule of law will not survive if it is approved.
The police and the civil authority are bound by the constitution and not by letters written by any BJP leader. This is a tragic situation.
Kapil Sibal said that illegal pressure is a serious issue but the point is that only Muslims are being linked to the encroachment. Such cases are also happening in other states.
“We will ask the MCD to provide a demolition statement,” Justice L Nageshwar Rao said.
We will ask them to enter the affidavit and you enter the counter. Until the matter is decided, the status quo in Jahangirpuri will remain the same.
